Under the Americans with Disabilities Act (ADA), employers offering wellness programs that collect employee health information must provide a notice to employees informing them 1) what information will be collected, 2) how it will be used, 3) who will receive it, and 4) what will be done to keep it confidential. With the final rules for employer wellness programs recently released (see this month’s blog, “How Healthy is Your Plan?”), the U.S. Equal Employment Opportunity Commission (EEOC) has also provided a sample notice to help these employers comply with the new rules, found at their website.
